BatchPoint

Terms of Service

Last updated: September 11, 2026

These Terms govern your use of BatchPoint — farm record-keeping and food-safety compliance software for small produce farms and the organizations that support them — at batchpoint.app and the BatchPoint mobile apps for iOS and Android (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who we are

BatchPoint is operated by BatchPoint, based in Fresno County, California, USA. Contact: support@batchpoint.app. BatchPoint is an early-stage, independently operated product — see the Disclaimer of Warranties and Limitation of Liability sections below before relying on it for regulated recordkeeping.

2. Accounts

You must provide accurate information when you create an account and keep your login credentials confidential. You're responsible for all activity under your account. Tell us right away at support@batchpoint.app if you suspect unauthorized access.

The Service is intended for business use by farm operators, food-safety organizations, and their staff — not for children. See the Children section of our Privacy Policy.

3. Your data, and your responsibility for it

You own the crop, harvest, inventory, contact, and compliance records you enter into BatchPoint. We don't claim ownership of it, and you can export or delete it at any time (see our Privacy Policy for how retention and deletion work).

You're responsible for the accuracy of everything you enter — planting and harvest dates, seed sources and lot numbers, sanitation and pesticide logs, worker training records, and every other field. BatchPoint stores and formats your records; it does not verify them.

4. Food-safety compliance disclaimer

BatchPoint is a record-keeping tool, not a compliance guarantee. It helps you organize the records that FSMA, GAP audits, and buyers typically ask for — but keeping your farm compliant with FDA, USDA, state, or buyer-specific food-safety requirements is your responsibility, not ours. Regulations change, and requirements vary by operation, crop, and buyer.

BatchPoint is not a substitute for qualified food-safety, legal, or regulatory advice. We make no guarantee that using the Service will satisfy any particular audit, inspection, or regulatory requirement. If a report, binder, or label the Service generates contains an error because of what was entered or because of a software defect, we are not liable for any resulting compliance failure, rejected audit, lost sale, or regulatory penalty — see Limitation of Liability below.

5. The AI assistant

BatchPoint includes an optional AI assistant powered by Google's Gemini API (see our Privacy Policy for what's sent to it). Its responses are generated by a third-party AI model and may be incomplete, out of date, or wrong. It is not food-safety, legal, financial, or agronomic advice, and you should not treat it as such. Verify anything important before relying on it.

6. Organizations and shared access

If you accept an invitation from a supporting organization (a co-op, food hub, or nonprofit), that organization can view your crop, inventory, harvest, and compliance records. You can end that access at any time from within the Service; doing so returns your account to a read-only state until you join another organization or an individual-subscription option becomes available. See our Privacy Policy for details.

If you administer an organization account, you're responsible for the conduct of the staff you give access to, and for having the farms' consent to view their records.

7. Public traceability pages

When you publish a batch for traceability, BatchPoint creates a public web page reachable by QR code or link, with no login required. You're solely responsible for what you choose to publish there — don't put anything you don't want publicly visible. Once printed on a label and shipped, a published record may remain reachable indefinitely, including via retained copies outside our control (a scanned or photographed label, for instance).

8. Payments and Stripe Connect

If you use BatchPoint's invoicing and order features, payments are processed through Stripe Connect. BatchPoint is not a party to the underlying sale of produce — the contract for that sale is between the farm (or organization) and the buyer. We don't hold, take custody of, or guarantee any payment; Stripe moves funds directly, and payout timing, disputes, chargebacks, and refunds are handled per Stripe's own terms and standard practices.

You're responsible for the accuracy of the invoices, prices, and quantities you issue, and for any tax obligations arising from your sales. We're not liable for a delayed payout, chargeback, or a dispute between you and a buyer.

9. Acceptable use

Don't use BatchPoint to:

We may suspend or terminate an account that violates this section.

10. Intellectual property

BatchPoint and its software, design, and branding are owned by us and are not licensed to you beyond what's needed to use the Service as intended. You keep all rights to the records and content you enter, and grant us only the license needed to store, process, and display it back to you (and to anyone you choose to share it with, like an organization or a public traceability page) as part of operating the Service.

11. Third-party services

The Service relies on providers including Supabase, Vercel, Stripe, Resend, Google (Gemini), and a QR-rendering service — see our Privacy Policy for what each one handles. We're not responsible for outages, errors, or policy changes on their end, though we'll work to keep the Service running and to migrate providers if needed.

12. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, secure, or that any defect will be corrected. BatchPoint is early-stage software; use it accordingly, and keep your own backups of anything critical (export is built in for exactly this reason).

13. Limitation of liability

To the maximum extent permitted by law, BatchPoint and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service — including any compliance failure, rejected audit, spoiled or recalled produce, or payment dispute — even if we've been advised of the possibility. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim arose (which, for most farmer accounts, is currently $0).

Some jurisdictions don't allow these limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold BatchPoint harmless from claims, damages, and expenses (including reasonable legal fees) arising from your records, your use of the Service in violation of these Terms, or your violation of any law or a third party's rights.

15. Term and termination

These Terms apply for as long as you use the Service. You can delete your account at any time from Settings › Danger Zone (see our Privacy Policy for what that does to your data). We may suspend or terminate an account for violating these Terms, non-use, or if we discontinue the Service — where practical, we'll give notice and a chance to export your data first.

16. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Fresno County, California, and you consent to that venue.

17. Changes to these Terms

If we make a material change, we'll update the date at the top of this page and, where the change meaningfully affects your rights, notify you in the app or by email. Continued use of the Service after a change takes effect means you accept the updated Terms.
